2) Não ofende o ato jurídico perfeito a aplicação imediata do art. 14 da Emenda Constitucional n. 20/1998 e do art. 5º da Emenda Constitucional n. 41/2003 aos bene­fícios previdenciários limitados ao teto do regime geral de previdência estabelecido antes da vigência dessas normas.

3) Os benefícios previdenciários devem ser regulados pela lei vigente ao tempo em que preenchidos os requisitos necessários à sua concessão, não sendo possível a aplicação de lei posterior.

4) Nos processos relativos a benefícios previdenciários não há a prescrição do fundo de direito, mas apenas das verbas pleiteadas anteriormente aos cinco anos da propositura da ação.

6) A correção monetária de débitos relativos a benefícios previdenciários cobrados em juízo tem como termo inicial a data do vencimento da prestação a ser corrigida.

7) Nas demandas que tratam de benefícios previdenciários aplica-se o Índice Nacio­nal de Preços ao Consumidor - INPC como índice de correção monetária (art. 41-A da Lei n. 8.213/1991, introduzido pela Lei 11.430/2006), tendo em vista a declaração de inconstitucionalidade parcial por arrastamento do art. 5º da Lei n. 11.960/2009 (ADIs 4.357/DF e 4.425/DF).

9) Os juros moratórios incidentes nas ações relativas a benefícios previdenciários devem ser calculados segundo os índices oficiais aplicados à caderneta de poupança, a partir da vigência da Lei n. 11.960/2009.

10) Na hipótese em que há o reconhecimento do direito do autor à correção do salário de contribuição de fevereiro de 1994 pelo Índice de Reajuste do Salário Míni­mo - IRSM, o valor da nova renda mensal inicial do seu benefício deverá ficar res­trito ao limite máximo do salário de contribuição vigente à época da implantação do benefício.

11) Não cabe a aplicação dos mesmos índices de reajuste dos benefícios de valor mínimo (art. 201, §2 da CF/88) aos demais benefícios previdenciários, uma vez que para estes o índice a ser aplicado será o INPC (art. 41-A da Lei n. 8.213/1991).

12) Os sucessores do segurado não possuem legitimidade para pleitear direito personalíssimo não exercido em vida pelo titular do benefício previdenciário.

13) É possível a renúncia à aposentadoria por tempo de serviço (desaposentação) objetivando a concessão de novo benefício da mesma natureza (reaposentação), com o cômputo dos salários de contribuição posteriores à aposentadoria anterior, não sendo exigível, nesse caso, a devolução dos valores até então recebidos a título de aposentadoria. 14) Os pedidos de desaposentação não se sujeitam ao prazo decadencial de dez anos previsto no art. 103 da Lei n. 8.213/1991, pois não configuram hipótese de revisão de benefício concedido.

15) Os valores de benefícios previdenciários recebidos por força de tutela antecipa­da posteriormente revogada devem ser devolvidos, haja vista a reversibilidade da medida antecipatória, a ausência de boa-fé objetiva do beneficiário e a vedação do enriquecimento sem causa.

17) Os valores relativos a benefícios previdenciários pagos a maior ao segurado por força de decisão judicial transitada em julgado, que venha a ser rescindida, não são passíveis de devolução.
